Airport and operational issues
In the aviation sector, flights depend on the coordination between airlines, airports, air traffic control (ATC) and ground handling operators. Disruptions, such as delays and cancellations, regularly give rise to legal questions regarding responsibility and liability.
The key issue is which party caused the disruption and whether it was within that party’s sphere of influence. This requires an analysis of both the legal frameworks and the actual operations.
Capacity and causes
Disruptions often arise from a combination of factors, such as:
- weather conditions;
- ATC decisions;
- capacity constraints;
- operational problems.
The decisive factor is which factor predominates and to whom it can be attributed.
Role of airports and ground handlers
Airports and service providers can also play an important role in this regard. Airport operators determine infrastructure and capacity, whilst ground handlers are responsible for processes such as baggage handling, boarding and turnaround.
Errors at these stages can lead to delays or damage. The question then is who is liable.
In addition, disputes regularly arise over airport fees and charges, such as the lawfulness and passing on of costs.

Requirements for CO2 reduction in state aid to KLM?
An important topic in aviation is the reduction of CO2 emmission. Aircraft burn kerosene and therefore emit CO2. Recently, the preliminary relief judge of the District Court of The Hague issued a judgment in the context of CO2 reduction by the Dutch airline KLM and the state aid that KLM received due to the corona pandemic. What conditions for CO2 reduction can be attached to that state aid?
IATA Travel Pass: ins and outs
International air traffic has been (partially) stopped for quite some time now. The corona crisis has had an enormous impact on the aviation industry. Restarting air traffic brings with it the necessary challenges in terms of information supply to passengers, the requirements of various governments, but also the requirements for airports and airlines.
Do airlines have to compensate passengers financially in case of a strike?
The rights of air passengers in case of delay, cancellation or denied boarding are regulated by EU Regulation 261/2004. The Regulation entitles passengers in certain cases to standardized financial compensation of €250, €400 or €600 depending on the flight distance.
